Hybrid Battery 911, LLC (hereinafter “HB911”) is happy to provide our customers with a 5 YEAR/70,000 MILE WARRANTY. If you choose to purchase this warranty, please READ and SAVE a copy of the warranty. Print or download a copy for your records or to keep in the car along with the product receipt..
***WE DO NOT RECOMMEND THIS WARRANTY OR A NEW HYBRID BATTERY TO ANYONE THAT DOES NOT DRIVE THEIR VEHICLE AT LEAST 2,000 MILES PER YEAR OR AT LEAST 166 MILES PER MONTH.***
All warranty terms detailed here are accepted upon payment to the subscription service or annual warranty acceptance provided by HB911. These warranty terms provided here must be agreed upon before any payment is made to HB911 for the purpose of securing this NEW HYBRID BATTERY 5 YEAR/70,000 MILE WARRANTY and coverage. HB911 has the right to refuse service to anyone or cancel warranty coverage.
Warranty Coverage SELLER’S LIABILITY IS LIMITED TO REPLACING DEFECTIVE OR FAILED PRODUCT ORIGINALLY INSTALLED BY SELLER. On each submitted warranty claim, we reserve the right to replace the customer’s current failed revitalized hybrid battery previously installed by one of our trained technicians with an equivalent fully reconditioned battery at no charge to the customer if the monthly warranty payment and/or the annual warranty payment is current at the time when the warranty service is requested, and the warranty has not been voided by any of the reasons noted herein.
NOTE: Any monthly payment that is missed, for whatever reason, will cause the warranty to be null and void. A reinstatement fee of $699, plus $19.99 for every missed month of coverage, is applicable within 90 days of cancellation (NO EXCEPTIONS) in order to reinstate the NEW HYBRID BATTERY 5 YEAR/70,000 MILE WARRANTY.
Warranty Duration of Coverage This warranty on the installed reconditioned hybrid battery will remain in force for the lifetime of only the vehicle that it has been initially installed in, if the conditions outlined in this warranty are met and so long as HB911 remains in business.
Location of Warranty Service Work to be Performed This NEW HYBRID BATTERY 5 YEAR/70,000 MILE WARRANTY is valid only in the states HB911 currently services, unless otherwise noted. If the reconditioned hybrid battery and warranty were purchased in the currently serviced states and then subsequently fails in a state not currently serviced by us, the customer must bring the vehicle to any one of the states that we are currently servicing to have the warranty service done. Transportation, towing, or any other service associated with bringing the vehicle into one of those states is solely the financial responsibility of the customer. Commercial Use Vehicles Any vehicle driven over 45,000 miles/YEAR is classified as a COMMERCIAL USE vehicle for the terms of coverage of this warranty. Failure to disclose the commercial use of the vehicle, before warranty coverage begins, will require an additional charge of $699 in order to remain on the warranty. HB911 NEW HYBRID BATTERY 5 YEAR/70,000 MILE WARRANTY does cover vehicles used for commercial services such as UBER, LYFT, TAXI OR COURIER SERVICES at a different monetary rate than a non-commercial vehicle, BUT may still have some special restrictions on mileage. (Call 1-888-761-1911 and ask a representative for the details and pricing of warranty coverage for COMMERCIAL USE vehicles.)
What conditions terminate or nullify my warranty?
HB911 is not responsible for any defects where the cause of those defects is determined to result from customer’s actions, negligence or insufficient maintenance which includes, but is not limited to, the following:
- Vehicle is immobile for any time period of 14 consecutive days or more.
- If the quality control, tamper-proof stickers that are applied by HB911 before installation are removed, cut, or tampered with in any way.
- Misuse, abuse, or any accident-causing damage to the hybrid battery including but not limited to engine failure or poor engine power conditions.
- Fuel or oil run out.
- NON-response by the customer to any fault codes given to the customer by our technician at the time of the original reconditioned battery installation which indicates an issue or part that, may or may not be related to the HYBRID BATTERY itself, but that have been known to damage the hybrid battery. These fault codes and the corresponding parts/issues MUST be fixed or replaced within 14 days of the initial battery installation to qualify for a warranty replacement hybrid battery.
- Alteration of the hybrid battery of any kind, including attaching any aftermarket accessory.
- Improper removal/installation of the hybrid battery or ANY hybrid battery component.
- Exposure to harsh chemicals or excessive moisture in or around the HYBRID BATTERY.
- Damage caused by infestation of pests, such as; roaches, rodents, ants, etc. that could cause damage to the integrity of the connecting wires, etc.
- Damage caused by natural disasters, such as; fire, tornado, hurricane, and flood, or any force majeure.
***The second-generation Prius (model year 2004-2009) has a digital dashboard (officially called the “combination meter”, also known as an “instrument cluster”). In the case of a failed or failing “combination meter”, the customer MUST have this repaired BEFORE any warranty repair work will be performed.
What could cause me to have additional charges even if I have this warranty?
****For the purposes of coverage of this NEW HYBRID BATTERY 5 YEAR/70,000 MILE WARRANTY, mileage is calculated by deducting the last mileage from your odometer reading (taken at the previous install), from your current mileage, divided by the amount of time that has passed, multiplied by 12 months. HB911 must be able to readcurrent mileage. Inability to read current mileage will nullify your service appointment. (Please see “combination meter” listed in the “Terminate or Nullify My Warranty” section.)
Warranty Claim Conditions To request a warranty service, HB911 requires that customer has the fault code(s) scanned through an OBD scanner and provide a picture showing all code(s) currently present, prior to warranty appointment being scheduled. These are codes that would have been required to do the initial battery change out.
Why am I being inconvenienced more? It is imperative that hybrid battery codes show current or confirmed to move forward with any warranty claim. Should there be non-hybrid battery related codes that adversely affect the hybrid battery’s performance, those will need to be addressed by repair or replacement prior to a hybrid battery change out.
HB911 is not responsible for any reimbursement to customer on diagnostic fees or towing charges incurred with customer’s vehicle. There is a $399 mandatory deposit on all warranty claims that cannot or do not provide current or confirmed codes. This deposit will be refunded to the customer if the hybrid battery is replaced due to defect or fault.
Should an HB911 technician be dispatched to a customer’s warranty claim call and no hybrid battery fault code(s) can be obtained while on site to do the battery replacement service, the customer will be charged a non-refundable $399 service call fee, even if the hybrid battery is not replaced at the time of service. HB911 reserves the right to schedule or not schedule warranty claim work when no hybrid battery fault codes are given. Please have your car scanned in advance of scheduling this valuable appointment, so that we can service your vehicle.
Warranty Terms Changes Customers will be notified of any changes to our terms and agreements through the provided subscription service and by email. It is the sole responsibility of the customer to make sure that we have their current and correct email address and cell phone number. Any future changes to this warranty will nullify any previously published or purchased warranty, but will not decrease the value of the services offered. It is the responsibility of the customer to contact HB911 should they choose to end their warranty plan, either in writing, via the customer portal or by calling to cancel payment on the monthly or yearly warranty payment plan. Continued subscription payment or yearly warranty payment is acceptance of the terms and agreements outlined herein.
Transferability The 5 YEAR/70,000 MILE WARRANTY is fully transferable to the next owner of the vehicle that received the reconditioned hybrid battery from HB911. This transfer must be completed within 14 days of the sale of the vehicle and is free of charge. The warranty can only be transferred once. HB911 WARRANTS THAT THE INSTALLED RECONDITONED HYBRID BATTERY IS FREE FROM DEFECTS IN MATERIAL AND WORKMANSHIP FOR LIFETIME FROM THE DATE OF PURCHASE, EXCEPT IF NOTED OTHERWISE.
Release By accepting this product and service from HB911, owner of the vehicle does hereby waive and release any claim now or in the future against HB911, its agents, directors, employees, officers or customers, on account of any and all claims, suits, demands and legal proceedings, whether criminal or civil, damages, losses, liabilities (including, but not limited to, strict liability in tart), judgments, penalties, sanctions, fines, and any costs arising from, or in connection therewith, including legal fees which may result out of injury to or death or loss or damage to property or the loss of use of any property which may come about out of the possession, condition, use or operation of this product and service.
Jurisdiction Any suit, action or proceeding seeking to enforce any provision of, or based on any matter arising out of, or in connection with, this NEW HYBRID BATTERY 5 YEAR/70,000 MILE WARRANTY or the transactions contemplated hereby; may be brought in any county or state court located in Cobb County in the State of Georgia, and each of the parties hereby consents to the jurisdiction of such courts (and of the appropriate appellate courts therefrom) in any such suit, action or proceeding and irrevocably waives, to the fullest extent permitted by law, any objection which it may now or hereafter have to the laying of the venue of any such suit, action or proceeding in any such court or that any such suit, action or proceeding which is brought in any such court has been brought in an inconvenient forum. Process in any such suit, action or proceeding may be served on any party anywhere in the world, whether within or without the jurisdiction of any such court. Without limiting the foregoing, each party agrees that service of process on such party shall be deemed effective service of process on such party.
THE NEW HYBRID BATTERY 5 YEAR/70,000 MILE WARRANTY SET FORTH HEREIN IS EXCLUSIVE AND ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED BY BOTH PARTIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. IN NO EVENT SHALL HYBRID BATTERY 911, LLC BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES.
